Thank you for the opportunity to provide comments on the proposed amendment to Ontario Regulation 299/19 ADDITIONAL RESIDENTIAL UNITS. The Town of Halton Hills’ comments are attached and summarized below.

In regards to requiring that lot coverage be at least 45%, the Town would ask that zones with established historic character (e.g. Mature Neighbourhoods identified in local policies) be considered for exemption from the proposed maximum lot coverage provision of the Regulation. A considerable amount of study went into determining an appropriate lot coverage maximum in the Town's Mature Neighborhoods zoning standards. These maximums were also informed by residents and residents groups, who seek to maintain the historic character of these areas through more stringent lot standards.

Town staff have no issue with prohibiting FSI as a means restricting ARU sizes. However we are hoping more straightforward means of setting ARU maximums will still be permitted, including a hard size cap, and/or restricting to a certain percentage of the overall floor area of the main residential building.

Draft policies for detached ARUs in the Town’s Non-Urban Zones require they be within 30 metres of the main residential building. Municipal zoning should be permitted to enforce such a standard to ensure that detached ARUs are in close enough proximity to the main residential building to share a common access to the road and servicing.
