Jamesville housing development with references to CBC's article:

Does CN Rail operate under the legal threshold of noise and odor allowance, or does it exceed it? Would CN Rail need to update its operations in the yard/along the tracks? Is CN Rail concerned for Hamiltonians, or is it concerned about it's bottom line? Railroads should serve the interests of all Hamiltonians and Canadians.
Perhaps I could understand CN Rail's concerns (under the assumption that they are making the point in good faith) if housing was not there before, but it has. Indeed the evidence of such housing is still there. Active rail lines are surrounded by housing in all major cities in Ontario and across Canada. People get used to sound and vibration. In fact, owners and renters would already be aware, and clauses can be added to contracts to address it.
The JHD is only a couple of blocks away from downtown Hamilton, and residents would have access to many amenities. It is "prime real estate" with 475 potential units servicing people with market rates as well as affordable housing. Why on earth, in this housing crisis, is the land is sitting dilapidated and unusable? It has been 10 years, and that is inexcusable.
Let us not sit another 10 years with shovels in hand, watching and waiting and hoping for the best. CN Rail does not speak for future residents whom, if I may assume, would choose to live in a home near the rail line above having no certainty of having a home at all. Please push the MZO through and help Hamilton be the vibrate city its residents know it can be.
