The proposed regulation discourages the beneficial reuse of excess soil. It provides a new level of legislation that makes all clean fill “waste” and therefore “unacceptable” in the eye of the public and therefore their Municipal Councils. For the legislation to be effective the provincial should be the agency that grants permission to a receiving site or creates clear legislative requirements for acceptable reuse sites. GTA Fringe municipalities currently use site alteration by-laws as a truck traffic prohibition tool or a political NIMBY tool as there is no appeal process.
