The City of Mississauga agrees with a number of the proposed changes to the Ontario Heritage Act (OHA), we note that the proposed amendments will significantly impact the review and evaluation of listed and designated properties, administration and will result in a reduction of authority in heritage related matters. Staff notes that there has been little consultation with the municipality regarding the proposed changes. And the province has not yet circulated the updated guidance documents that are associated with the new regulations.
The City continues to call for a heritage professional to be included on the LPAT board since heritage related matters will no longer be going to the Conservation Review Board which consisted of professionals familiar with heritage related matters.
Amendments to the updated Ontario Heritage Tool Kit should be finalized before these legislative changes come into force.
Regulation specific comments are as follows:
1. The City of Mississauga notes that the use of ‘should’ rather than ‘shall’ contravenes the Provincial Policy Statement 2020 when read that a “property that is determined to be of cultural heritage value or interest should be protected and conserved for all generations”
2. The land registry currently does not accept images and accepts a formal survey. The City of Mississauga requests that the Ministry should clarify if the Land Registry can accommodate this new requirement.
3. The City of Mississauga requests a longer timeline to 120 days.
4. Again, The City of Mississauga would like to see a longer timeline of 180 days.
5. The City of Mississauga has no comment on this item.

8. The City of Mississauga supports this amendment.
9.Given the pandemic which continues to challenge all municipalities the City of Mississauga would rather suggest a later date of July 1, 2021 to bring the regulation into force.
