Thank you for the opportunity to comment on Bill 276, the Supporting Recovery and Competitiveness Act, 2021.

Town of Newmarket staff welcome most of the practical amendments proposed to Sections 50, 51, 53, and 57 of the Planning Act, R.S.O. 1990, and recognize the varying needs each seeks to address. However, we would like to express concerns in regards to the proposed Certificate of Cancellation.

Town of Newmarket staff respectfully request the Provincial Government reconsider the proposed Minister’s authority to issue a Certificate of Cancellation as this unilateral authority, combined with the ability to issue Certificates of Validation supersedes the municipal public planning process and further reduces municipal autonomy.

Should the Provincial Government proceed with the proposed Minister’s authority to issue a Certificate of Cancellation, we recommend due consideration be made in establishing criteria that warrant its use and that local municipal council be consulted prior to the issuance of Certificate of Cancellation.
