As an environmental consultant, I have observed that there has been a real attempt by developers to meet the requirements of O.Reg. 406/19. There will be a learning curve but developers, truckers, and others do not have the incentive to try and meet the requirements until they HAVE to.
I think that delaying the excess soil regulation requirements will result in losing the momentum. I think the best solution is to say that the requirements are applicable now. The MECP can conduct routine inspections but not fine or penalize people when they have done their best to understand and implement the requirements.
My honest opinion is to keep the requirements in place instead of delaying it and give people time to develop their procedures as they are doing.
