Proposed Amendments to O.Reg 525/98 under the Ontario Water Resources Act:
1. Minimizes the regulatory authority to effectively manage in building climate resilient communities, protecting water quality, and mitigating risks to drinking water sources
2. Expand on the exemptions for low-impact development (LID) works
3. Add exemptions for drainage works for roadways and railways, including railway projects by Metrolinx
4. Proposal allows certain stormwater management works to self-register on the EASR
5. Activities managed under the EASR do not require an ECA, monitoring and compliance
Proposed Amendments to O.Reg 287/07 made under the Clean Water Act, 2006:
1. Proponents would be required to identify whether the activity is a significant drinking water threat by a licensed Professional Engineer
2. Transitioning the responsibility from a government oversight to a licensed Engineer
Potential Impacts of O.Reg 525/98 and O.Reg 287/07 regulatory changes:
1. May impact water quality in the downstream watercourses against Provincial, Regional and CA’s Water Quality Objectives i.e. York Region Sewer and Storm By-laws and Lake Simcoe Protection Act
2. Development review of complex Site Plans, Plans of Subdivisions and Plans of Condominiums will require third-party reviewers and/or retain the services of the CA to maintain the level of service we currently have, resulting in additional Budget asks if not cost recoverable or if the scope is removed from the CA's Memo of Understanding. May have drainage issues, property damage and flooding implications downstream.
