Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

Proposal details

This proposal is for a new Environmental Compliance Approval (M&P Sewage) for Green Line Properties Limited for sewage treatment works to serve Hammock Harbour, located in the Township of Ramara, Ontario.

The proposal is to establish sewage works for the collection, treatment, and disposal of sewage generated by trailers. The system consists of a vacuum sewer system designed and to be constructed by Newterra, and connection of individual trailer holding tanks to gravity sewer system. Gravity sewers will drain to vacuum collection chambers, with a maximum of four trailers to be connected to each chamber.

The chambers will discharge to a vacuum forcemain, conveying sewage to the proposed NewTerra MicroClear Membrane Bioreactor (MBR) Wastewater Treatment Plant (WWTP). The WWTP will be a packaged treatment plant designed for treatment of 113 m3/day, with allowance for future upgrades to 210 m3/day of treatment.

The MBR effluent discharge will be via forcemain diffuser to surface water at the unnamed creek within the Atherley-Sucker Creek Wetland Watershed. Construction of the WWTP and vacuum system will also result in the abandonment of individual trailer leaching pits, abandonment of the existing large subsurface sewage disposal bed, and the pump out and abandonment of the two existing onsite septic tanks.
