Bulletin summary

On July 30, 2021, the Minister of Municipal Affairs and Housing filed a Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, with the Registrar of Regulations as Ontario Regulation (O. Reg.) 545/21. The City of Toronto requested that the Minister consider making the Zoning Order.

Why consultation isn't required

Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Bulletin details

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.

O. Reg. 545/21 provides relief from certain zoning requirements, including relief from vehicular and bicycle parking requirements, to facilitate the conversion of existing hotel rooms to 84 supportive housing units.

O. Reg. 545/21 applies to lands municipally known as 222 Spadina Avenue located in the City of Toronto. For illustrative purposes, the subject lands as shown in the map, the link to which is set out below.

Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 545/21 to be and to have always have been a by-law passed by the Council of the City of Toronto.
