Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
O. Reg. 333/22 and O. Reg. 334/22 provides permissions for a range and mix of residential, commercial, and institutional uses to support the development of a Transit-Oriented Community. Specifically, O. Reg. 333/22 provides for a maximum gross floor area for all buildings or structures of 7,222 square metres. O. Reg.. 334/22 provides for a maximum gross floor area for all buildings or structures of 10,923 square metres.
O. Reg. 333/22 applies to the lands known municipally as 165 Spadina Avenue, located on the north-east corner of Queen Street West and Spadina Avenue, in Toronto.
O. Reg. 334/22 applies to the lands known municipally as 443-455 Queen Street West, located on the south-west corner of Queen Street West and Spadina Avenue, in Toronto.
The lands subject to O. Reg. 333/22 are described as:
lands in the City of Toronto, in the Province of Ontario, being lands described as Lot 12, North Side of Queen Street, on Registered Plan D-10, as identified by Property Identification Number 21205-0098 (LT) registered in the Land Registry Office for the Land Titles Division of Toronto (No. 80).
For illustrative purposes, the lands subject to O. Reg. 334/22 are shown in the map below.
Pursuant to subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed O. Reg. 333/22 and O. Reg. 334/22 to be and to always have been a by-law passed by the Council of the City of Toronto.
