You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.

There is an additional “leave to appeal” right under the Environmental Bill of Rights.

Who can appeal

A notice of appeal can be submitted by:

A notice of appeal can’t be submitted by:

  • an unincorporated association
  • an unincorporated group

You can, however, submit a notice of appeal as a member of the unincorporated association or group.

You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

Proposal details

The purpose of this application is to extend an existing easement (Part 1 of Plan 23R-14554) created in 2018 for access purposes across the property composed of PIN 42096-0203, PIN 42096-0204, PIN 42096-0205 and PIN 42096-0208 in favour of the property abutting to the west described as PIN 42096-0206 and PIN 42096-0207. The easement boundaries will be over PIN 42069-0208 for the benefit of PIN 42069-0207. PIN 42069-0208 contains a driveway that is currently being shared to access dwellings on each property. The proposed easement would be extended by approximately 264 metres to run the full length of the benefitting lot in order to provide access to the back 2 hectares (5 acres) of the property off of the current road. Both properties contain permanent residential homes serviced by individual wells and septic systems and contain frontage on Leach Road which is a public road maintained by the Wainwright Local Roads Board. The subject lands abut the City of Dryden’s northern boundary.
