Decision summary

A decision was made to approve a site-specific amendment to remove certain lands in the Town of Oakville from the Parkway Belt West Plan (PBWP) and the associated Minister's Zoning Order (MZO), filed as Ontario Regulation 481/73. 

The PBWP amendment is approved as amendment No. 247 and the MZO amendment is filed as Ontario Regulation 48/26.

Decision details

The lands were removed in the Town of Oakville, from the Minister’s Zoning Order, filed as Ontario Regulation 481/73, through Amending Regulation 48/26 and from the Parkway Belt West Plan through Amendment No. 247 to facilitate future industrial and office uses.

The amending regulation and the Parkway Belt West Plan amendment removed lands municipally known as 4243 Sixth Line, located East of Sixth Line, North of William Halton Parkway, in the Town of Oakville, being lands legally described as part of Lot 15, in Concession II (Trafalgar), North of Dundas Street, being Parts 1 to 8 on Reference Plan 20R-22344 , and further identified by Property Identification Numbers 24929-0012 (LT) and 24929-7130 (LT). The lands removed are approximately 3.90 hectares in size.

Other Information

The Parkway Belt West Plan is a provincial development plan created in 1978 that provides for the development of a multipurpose infrastructure corridor, urban separator and linked open space system across the Greater Toronto Area. The process to amend the Parkway Belt West Plan is provided in the Ontario Planning and Development Act, 1994.

The Minister’s Zoning Order, filed as Ontario Regulation 481/73, was made in 1973 to implement the Parkway Belt West Plan. The Zoning Order generally only permits low impact land uses including agricultural uses, and accessory buildings, and structures that will be used for agricultural operations. Section 17 of the Ontario Planning and Development Act, 1994, allows the Minister of Municipal Affairs and Housing to exercise the powers conferred upon the Minister under clause 47(1) (a) of the Planning Act, with respect to any land in an area covered by a development plan under section 4 of the Ontario Planning and Development Act, 1994.

Why consultation isn't required

Part II of the Environmental Bill of Rights, 1993 does not apply to a proposal to make a Minister's Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.

Proposal details

Take notice that the Ministry of Municipal Affairs and Housing received two privately initiated applications requesting an amendment to the Parkway Belt West Plan and the Plan’s associated Minister’s Zoning Order, filed as Ontario Regulation 481/73, for lands municipally known as 4243 Sixth Line in the Town of Oakville, Halton Region (“the subject lands”). The subject lands are approximately 3.90 hectares in size.

The applications propose to remove the subject lands from the Parkway Belt West Plan, ‘General Complementary Use’ within the ‘Complementary Use Area’ and from the associated Minister’s Zoning Order to facilitate future employment uses on the subject lands.

Should the subject lands be removed from the Parkway Belt West Plan and the Minister’s Zoning Order, permitted uses would continue to be subject to the Town of Oakville’s Official Plan and Zoning By-law. Any future development on the subject lands would require approval from the Town of Oakville.
