Proposal summary
The Minister of Municipal Affairs and Housing received a request to make a Minister’s Zoning Order in the City of Toronto. The Ministry is seeking input on whether this request should be considered and any additional information that may help inform the Minister’s decision-making.
Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the Ministry is providing public notice of this request for consultation.
Proposal details
The Ministry of Municipal Affairs and Housing is consulting on a request from Goldberg Group on behalf of CVH (No.11) LP and Southbridge Health Care GP Inc. for a Minister’s Zoning Order (MZO) to facilitate a long-term care facility on the lands at 1145 and 1155 Albion Road in the City of Toronto.
A letter from the Minister of Long-Term Care was received in support of the MZO request to accelerate the creation of a new long-term care home on the subject lands.
An MZO, made pursuant to section 47 of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land, and prevails over the existing municipal zoning by-law to the extent there is any conflict.
The subject lands are approximately 2.64 acres and located at the southwest corner of Albion Road and John Grubb Court, approximately 100 metres west of Islington Avenue. The subject lands currently contain a 3-storey long-term care facility with 184 beds.
If made, the requested MZO would permit a new 12-storey long-term care facility with 320 beds and commercial space at grade, replacing the existing facility onsite.
Specifically, the requested MZO seeks to permit long-term care home, nursing home, retirement home and accessory uses on the subject lands. The requested MZO also proposes exceptions to the requirements of City of Toronto Zoning By-law 569-2013 with respect to number of long-term care beds, lot area, frontage and coverage, building height and setback, gross floor area, projection and encroachment, amenity space, landscaping, parking, bicycle parking and loading.
This MZO request also seeks the Minister to use his enhanced authority pursuant to clause 47(4.3)(a) of the Planning Act to remove use of site plan control.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision.
This proposal for an MZO is posted for consultation as a “regulation” notice type due to webform template formatting limitations. However, as a result of amendments to section 47 of the Planning Act by Bill 60, Fighting Delays, Building Faster Act, 2025, which received Royal Assent on November 27, 2025, the proposed MZO, if made, will not be a regulation and will not be filed with the Registrar of Regulations.
