Why consultation isn't required

On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.

Proposal details

A risk assessment was undertaken for this property to establish the risks that the contaminants identified in the risk assessment may pose to future users and to identify appropriate risk management measures to be implemented to ensure that the property is suitable for the intended uses of Residential, Parkland, Institutional, Commercial and Community defined by O. Reg. 153/04. A municipal pumping station will also be constructed on the property which is considered as Industrial use under the regulation.

  • Revised Risk Assessment Report for Pier 8, Hamilton, Ontario, report prepared by Dillon Consulting Ltd., dated April 2018
  • Revised Risk Assessment Report for Pier 8, Hamilton, Ontario, report prepared by Dillon Consulting Ltd., dated January 31, 2019
  • “Appendix E - Risk Management Plan, June 2019”, received by DWEC on June 7, 2019, via e-mail from Brent Loney, Dillon Consulting Ltd., with the following document attached:
    • Appendix E_RMP_updated 20190604.pdf.
  • Revised Risk Assessment Report (4th Submission) for Pier 8, Hamilton, Ontario, report prepared by Dillon Consulting Ltd., dated October 11, 2019

Based on the documents provided to us as part of the risk assessment report, the reviewers can confirm that the risk assessment has been conducted in accordance with the Environmental Protection Act (the Act), Ontario Regulation 153/04 (the regulation), and the associated guidance documents. The director provided the proponent with written Notice of the Director’s Decision to accept risk assessment number 3673-A9GSFX relating to the property in accordance with section 168.5 of the Act on December 10, 2019.

The director is considering the issuance of a CPU in relation to the site. The proposed CPU incorporates the risk management measures proposed in the risk assessment and additional conditions proposed by the director. Draft CPU number 5340-BKPS2V is attached.
