Why consultation isn't required
On April 1, 2020, the Ontario Government made a temporary regulation to respond to the COVID-19 outbreak. Ontario Regulation 115/20 exempts all proposals for policies, acts, regulations and instruments from posting requirements under the EBR until 30 days after the declared emergency is terminated.

This proposal is for an amendment to Environmental Compliance Approval (Waste Disposal Site) No. A7313906, which was issued for the use and operations of a 13 hectare landfill site (the Kendall Wood Waste Landfill Site).
A Summary of the changes are as follows:
The Kendall Wood Waste Disposal Site, Environmental Compliance Approval No. A7313906 (the ECA), was formally closed with the most recent amendment (Notice No. 8). The Site has not accepted any wood waste since 2005 and has not accepted any new waste since 2011. The proposed changes reflect the most recent financial assurance (FA) re-evaluation based on current post closure activities as well as changes to the existing groundwater monitoring program based on the 2017-2019 Triennial Groundwater Monitoring Report.
Groundwater Monitoring Program Amendment:
The target list of parameters for the groundwater monitoring program are found in Schedule C of the ECA, Notice No. 8. This application proposes to remove the benzene, toluene, ethylbenzene and xylene (BTEX), as well as volatile organic compounds (VOCs) from the required parameters, beginning in 2020. The rationale can be found in the attached 2017-2019 Triennial Groundwater Monitoring Report.
