Effects of consultation

The regional Municipality of Niagara requested that since the taking is located within a Highly Vulnerable Aquifer they recommend the ministry consider hydrologic sensitivity of the area when processing the application. The Region does not have any concerns or objections to this Permit to Take Water, subject to the ministry ensuring that the proposed water taking does not negatively impact the quality and quantity of water.

Ministry response:

The technical review indicated that the municipal comments have no affect on the review completed for this application as the recommendation is for a short-term dewatering permit only.

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?
