Exception summary

Increased quantities of leaf and yard (L&Y) waste have resulted due to more people working remotely and doing more yard work as a result of the COVID-19 pandemic, the ministry issued an emergency approval to the company at their Richmond Hill location to allow a temporary annual increase of 8,000 tonnes of L&Y waste for the year 2020 only.

Why consultation isn't required

Requirements for public notification on the Environmental Bill of Rights registry do not apply where, in the minister’s opinion, the delay involved in giving notice to the public, in allowing time for public response to the notice, or in considering the response to the notice would result in:

  1. danger to the health or safety of any person;
  2. harm or serious risk of harm to the environment; or
  3. injury or damage or serious risk of injury or damage to any person.

Approval was issued without public consultation as it was determined that a delay could result in harm or serious risk of harm to the environment.

Exception details

The director provided emergency authorization to the company on November 19, 2020. The following factors were considered when making this decision:

  1. Illegal dumping of L&Y waste in roadside ditches leading to drainage problems causing flooding of properties and roadways leading to unsafe conditions. Flooding also poses an increased risk to the environment. 
  2. Increased burning of L&Y waste in backyards and rural areas creating air pollution and increasing the risk of home and property fires. 
  3. Increased GHG emissions due to L&Y waste needing to be shipped/trucked further from the GTA for proper handling/processing. 
  4. Increased disposal of L&Y as a waste in landfills - this results in increased GHG emissions and reduces existing landfill capacity and disposal of L&Y wastes a valuable resource. 
  5. Increase the time that contractors staff travel in vehicles together increasing the risk for transmission of COVID-19.

The approval issued includes requirements for the company to adhere to existing conditions in the approval for the site.
