Decision details
The application for consent, 60-C-219096 is draft approved subject to conditions. The applicants have two years to satisfy standard conditions of draft approval, otherwise approval will lapse. The approval can be appealed using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before May 12, 2025.
Conditions include: Flowage easements, letter confirming adequate sewage disposal, letter from health unit confirming suitability for a septic system, consent agreement be registered on the title of the properties preventing development from occurring near the fish spawning sites and the archaeological site (development restrictions including no development within 30 metres of shoreline), a stage 3 archaeological assessment and Offer of purchase and sale agreement outlining environmental best practices.
Effects of consultation
As a result of the ERO postings, ministry staff received correspondence from the chiefs of Wauzhushk Onigum Nation and Niisaachewan Anishinaabe Nation, via their consultant (Narratives Inc.), objecting to the applications. Resulting in a dialogue between the ministry, applicant, Wauzhushk Onigum Nation and Niisaachewan Anishinaabe Nation.
The ministry's conditions of draft approval will help address the communities’ concerns by requiring that a consent agreement be registered on the title of the properties preventing development from occurring near the fish spawning sites and the archaeological site; if development is considered in the future on the retained property shoreline, a stage 3 archaeological assessment involving Indigenous communities will need to be completed before any site disturbance occurs.

Original proposal
Proposal details
The purpose of this application for consent 60-C-219096 is to sever PIN 42150-2161, a 24.15 ha property, into a one of three (3) new lots for resource-based recreational use. The three new lots are currently vacant and will be serviced by individual sewage systems and lake water. The retained lot contains a seasonal residence and boathouse serviced by an approved sewage system and surface water from the lake.
Proposed lot 1 will be 1.15 ha in size with 65 metres of frontage on Lake of the Woods and a depth of 200 metres. The proposed retained lot will be 19.9 ha in size with 590 m of frontage and 425 m of depth. The property is accessed by water from the Kenora Recreation Centre where parking and a public boat launch is available. The subject lands are located approximately 10 km south of the City of Kenora municipal boundary.
