We issued an approval to 2374868 Ontario Inc. for their 75 Udine Avenue, Welland site to authorize the receipt of liquid excess soil and the dewatering of that material for reuse off-site.
Site capacity will be limited to 100 tonnes of material received per day, with up to 100 tonnes of liquid and 350 tonnes of process soil being stored on-site. A groundwater monitoring plan has been implemented for the site to ensure that process water that has been infiltrated does not cause off-site impacts. Dewatered soil from the operation will also be used to construct a noise-attenuating berm around the site.

1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:

- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision

- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see

What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

Proposal details
This proposal is for an Environmental Compliance Approval (waste disposal site) for a 2.9-hectare hydrovac waste processing facility located in the City of Welland, Regional Municipality of Niagara. The facility collects liquid soil from hydrovac operations at utility, municipal, and commercial sites.
The soil and water mixture is placed in stockpiles, water gravity drains off, and the dried soil is sampled for chemical analysis to confirm that it is acceptable for sale or reuse to off-site users or for use on site to construct privacy berms. The maximum quantity of waste delivered to the site on any given day is 10,000 cubic metres, with a maximum storage capacity of 2,000 tonnes.
The facility operates from 7 a.m. to 6 p.m. Monday to Friday for 50 weeks of the year, and will occasionally provide hydrovac services outside of typical operating hours.
