Decision details
The SWM works comprise of erosion control works, and include an expanded reservoir/pond with a micropool. The reservoir will provide an increased level of flood protection during full spray operations during fresh pack season, prior to discharge to the downstream Wastewater Treatment Plant and during off season, discharge to East Sydenham River as per the existing ECA requirements. The works are limited to the spray irrigation field.
Effects of consultation
Comment #1 was supportive of the proposal.
With regards to Comment #2, this project is not connected in any way to the York1 proposal (IDS ECA Application Reference number 1806-CWAR5Q submitted by Environmental Waste Solutions Limited). This project is for an existing tomato processing plant. The project, which is located on Treaty 2 lands is within the existing footprint of the Conagra facility, will improve the management of water from Conagra’s spray field to temporarily store and pump the water to the municipal wastewater treatment plant. This project was initiated at the request of the Ontario Ministry of the Environment, Conservation and Parks to better manage water at the spray field. It is a common method used to manage wastewater during vegetable processing. The proposal has been reviewed and approved by the St. Clair Region Conservation Authority (SCRCA).

1. Prepare your application

What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
