Effects of consultation

MECP staff reviewed and considered all received comments regarding this proposal as outlined below:

Comment ID number 100037: Who is Jane St. Nominee Inc.? What are they building? Could not find any information about the company on the internet.

Response: Jane St. Nominee Inc. is business corporation registered in Ontario under Ontario Corporation number 2776135. The company was created on September 08, 2020 as indicated on the Certificate of Status issued by the Ministry of Public and Business Service Delivery.

Comment via email: Please also ensure that the full extent of approvals required for sanitary and servicing is considered in the scope of your review given York Region's approval of the prepaid development charges agreement June, 2020.

Response: Sanitary sewer connection is available for development of Block 34E, a non-residential (warehouses) development which will rely on an existing municipal sewer infrastructure. Under the Ontario Regulation 525/98, section 53 of the OWRA do not apply to the establishment of service connection. The regulation defines “service connection” as the pipe portion of a sewage works that extends from a sewer to the property line of a property serviced by the sewer. The City of Vaughan is reviewing the proponent’s application for service connection. The June 2020 prepaid development charges agreement the commenter is referring to is for Block 27 which is a residential development.

The application under ERO number 019-8815 has been submitted by Jane St.Nominee Inc, to the ministry for an Environmental Compliance Approval (ECA) for construction of a stormwater management (SWM) facility to manage stormwater from Block 34E (11260 Jane St & 11424 Jane St.). The review of this ECA application is separate from the review being conducted by the City of Vaughan for service connection. Moreover, the ministry’s ECAs, do not relieve any person of any obligation to comply with any provision of any applicable statute, regulation or other legal requirement, including, but not limited to, the obligation to obtain approval from other regulatory bodies.
