Decision summary
On December 20, 2024, the Minister of Municipal Affairs and Housing filed a Minister's Zoning Order with the Registrar of Regulations as Ontario Regulation (O. Reg.) 563/24 in the Town of Bradford West Gwillimbury. The Town of Bradford West Gwillimbury requested that the Minister consider making the Zoning Order.
Decision details
A Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of the land and the erection, location and use of any building or structure on the land. The Minister's Zoning Order was made based on a request from the Town of Bradford-West Gwillimbury.
O. Reg. 563/24 will facilitate the relocation of an existing concrete batching plant that is required to move due to the expropriation of the proponent’s existing site by the Ministry of Transportation to construct the Bradford Bypass. This decision will retain existing jobs in the Bradford West Gwillimbury community and permit the following:
- a concrete batching plant
- a temporary portable concrete batching plant
- associated facilities such as electric vehicle charging stations
- fuel storage and dispensing
- accessory uses
O. Reg. 563/24 applies to approximately 20 hectares of land at 1930 and 1934 Sideroad 5, Town of Bradford West Gwillimbury. See Location Map below.
Pursuant to the subsection 47(4) of the Planning Act, and except for the purposes of section 24, the Minister deemed this zoning order to be a by-law passed by the council of the Town of Bradford-West Gwillimbury.
Effects of consultation
All comments received were taken into consideration prior to a decision being made.
Through the consultation, some members of the public expressed concern that concrete production is damaging to the environment and will increase climate change, result in the loss of farmland, and impact the natural environment and food grown in the Holland Marsh.

Why consultation isn't required
Part II of the Environmental Bill of Rights Act, 1993 does not apply to proposals to make a Minister’s Zoning Order (MZO) under subsection 47(1) of the Planning Act, or to amend or revoke an MZO under subsection 47(8) of the Planning Act.
Although not required, the Ministry is providing public notice of this request for a zoning order.
Proposal details
A Minister’s Zoning Order, made pursuant to clause 47(1)(a) of the Planning Act, regulates the use of land and the erection, location and use of any building or structure on the land.
The Minister of Municipal Affairs and Housing is considering a request from the Town of Bradford West Gwillimbury to make a Minister’s Zoning Order at 1934 Sideroad 5, Bradford West Gwillimbury. This request would facilitate the relocation of an existing concrete batching plant that is required to move due to the expropriation of the proponent’s existing site by the Ministry of Transportation to construct the Bradford Bypass. This request would retain existing jobs in the Bradford West Gwillimbury community.
The Town of Bradford West Gwillimbury requested the Minister use his enhanced authorities pursuant to clauses 47 (4.3)(a) and (b) of the Planning Act to remove site plan approval and require the landowner enter into one or more agreements with the Town of Bradford West Gwillimbury dealing with matters listed in subsection 47 (4.4) of the Act on the subject lands.
The subject lands are currently agricultural lands. The site is approximately 20 hectares and is bound by 5th Side Road and Highway 400 to the east, 4th line to the south, 5th line and 5th Side Road to the north, and agricultural land to the west. See location map below.
The requested Zoning Order would permit:
- a concrete batching plant,
- associated facilities such as electric vehicle charging stations,
- fuel storage and dispensing,
- and other accessory uses.
To help ensure decisions are made in a transparent manner and support government priorities, the Ministry is seeking feedback on whether this request should be considered and any additional information that may help inform a decision.
