Please accept the following City of Kitchener staff comments in response to the ERO posting 019-9065. Staff request that the Province of Ontario consider the following two recommendations pertaining to the transition of land use planning matters to facilitate the introduction of a new policy statement issued under the Planning Act.

• planning applications submitted and deemed complete on or before October 19, 2024 where a decision by the approval authority is made within the prescribed time periods under subsections 17(40), 34(11) and 51(34) of the Planning Act must continue to be reviewed under the planning policy framework that exists at the time the applications were made; and,
• Planning matters appealed to the Tribunal must continue to be reviewed under the planning policy framework in place when the matter was submitted to the local approval authority.
