Proposed amendments to Bill 139
ACCOUNTABILITY
The LPAT (formerly the OMB) should report to the Minister of Municipal Affairs rather than the Lieutenant Governor
COMPOSITION
Members of the LPAT to be appointed by a joint-committee representing all political parties represented in the Ontario parliament Set a limit to the number of lawyers, mediators and real estate professionals on the LPAT Membership period to be limited to three years, with a one-time-only renewal for a further three years subject to confirmation by the joint committee on a “no-exception” basis
INPUT INTO DECISIONS
The LPAT should include the financial integrity of the developer in its decision criteria The LPAT should include input from local design review panels, where they exist, in its decision making process
PUBLIC ACCESS TO INFORMATION
The LPAT should provide complete transparency:
- provide a detailed membership profile (past and present)
- make available on its website clear, easy to understand, timely, comprehensive reports on its decisions
- establish performance measures that reflect both its effectiveness (based on its stated core values
- Accessibility, Fairness, Transparency, Timeliness and Integrity, Professionalism and Independence) and its efficiency
CONFIDENTIALITY ORDERS
The LPAT should only be able to make confidentiality orders where public security is involved. It should not be able to make them for any other reason, financial or personal
PENALTIES
The LPAT will commission random sampling of approved projects to ensure conformance to standards. Failure to meet these standards will result in major fines and/or demolition of the areas where these standards have been exceeded
