On behalf of Taykwa Tagamou Nation (TTN), a Treaty 9 Nation with longstanding partnerships in Ontario’s clean energy and infrastructure sectors, we strongly oppose the current form of Bill 5, Protect Ontario by Unleashing Our Economy Act, 2025. The proposed changes raise serious constitutional, legal, and environmental concerns—particularly the lack of consultation mechanisms under the Special Economic Zones Act (SEZA), and the proposed amendments to the Mining Act, Endangered Species Act, and Ontario Heritage Act.
We are deeply concerned that the SEZA enables large-scale development with minimal oversight and no requirement for Indigenous engagement, violating Section 35 of the Constitution Act and the UN Declaration on the Rights of Indigenous Peoples Act (UNDRIP Act). The fast-tracking of permits and reduction in consultation timelines undermine our ability to assess impacts and meaningfully engage with project proponents.
TTN calls for amendments to ensure:
• Mandatory consultation and accommodation prior to any SEZA designation or regulatory exemption;
• That no legislative mechanisms override constitutionally protected Indigenous rights or international obligations under UNDRIP;
• That Indigenous co-governance and land stewardship are embedded in all environmental and development planning processes.
We urge the Government of Ontario to work with us in co-developing a transparent, Nation-to-Nation regulatory model that balances development goals with rights recognition, environmental protection, and long-term reconciliation.
