I am writing to urge the provincial government to abandon its proposed changes to the Ontario Heritage Act (OHA) under Bill 5.
As an archaeologist, I am deeply concerned about the implications of this bill for the integrity of archaeological practice, the protection of heritage, and—most critically—the rights of Indigenous communities. Archaeological assessments are not bureaucratic hurdles; they are essential components of Canada’s ongoing reconciliation efforts. These assessments create vital opportunities for Indigenous communities to reconnect with, reclaim, and safeguard their cultural heritage.
The proposed elimination of mandatory heritage protections for certain development projects is a significant and troubling setback. It risks the destruction of irreplaceable cultural knowledge and undermines decades of collaboration between archaeologists, government bodies, and Indigenous nations.
Equally concerning are provisions in Bill 5 that redefine key terms such as “archaeological collections,” and grant police-like authority to seize artifacts and restrict access to heritage sites. These changes centralize control over heritage resources in ways that exclude the very communities and professionals most qualified and invested in their stewardship.
Bill 5 does not reflect the principles of ethical archaeology, nor does it align with the spirit of reconciliation enshrined in Canada's commitments to Indigenous Peoples. I strongly urge the government to withdraw or significantly revise this legislation and to engage in meaningful, transparent consultation with Indigenous nations, archaeologists, and heritage professionals.
I stand in solidarity with Ontario's First Nations, the archaeological community, and concerned members of the public in calling on the provincial government to reaffirm its commitment to safeguarding Ontario's shared heritage.
