Well firstly, this bill is entirely irrelevant if the Special Economic Zones Act, 2025 passes as currently written. The Minister and Lieutenant Governor in Council can implement the changes here or ignore the changes here as they please. So, my comments will be based on changes to that Act that give meaning to this Schedule.
I think the statute should set out more clear limits on the power of the power of the Lieutenant Governor in Council. It is disturbing to think that protections for potential evidence of genocide will be subject to the Lieutenant Governor in Council's continuing desire to do so. If, even for a second, they decide otherwise, that evidence can be destroyed and made unrecoverable.
I think that empowering the Minister to take more steps to protect Ontario's Heritage and enforce the Ontario Heritage Act is a good idea. I hope it is not undermined by other contents of Bill 5.
