Dear Ministry:

Thank you for the opportunity to provide comments on the Province’s ERO 025-1140 posting related to amendments to the Public Transportation and Highway Improvements Act. See below for Town of Caledon comments on this posting:

Comments on the amendments related to Municipal Contracts:

1.The Town of Caledon would like the opportunity to review and comment on any standard contract language that binds the municipality and third party contractor.

Comments on the amendments related to Municipal Road Standards:

2. The Town of Caledon is generally supportive of the provisions in Bill 60 to establish a framework to advance common municipal road standards across the Province including allowing for flexibility in this process to support successful standards implementation.

3. Many existing Province wide standards have been established in relation to road infrastructure design and construction. (i.e. OPS, OTM books, TAC GDM). Clarity is requested with regards to the future of these existing technical standards and/or adoption of these existing standards as common municipal road standards.

4. Caledon requests that there continue to be provisions in the current regulations and future regulations to allow for flexibility in adoption of common municipal standards that allow for implementation of municipal specific design and construction solutions that support the specific needs of each individual municipality.

5. Additional details are requested on the anticipated process for requests to the Minister that engineering standards not apply and the municipality’s role in this process.

6. Additional future regulations are needed to implement the proposed legislative amendments and common municipal road standards. Caledon should be adequately consultant during this process and Town staff should have the opportunity to be members of any technical groups or committees established by the Province for the development of common municipal standards (either through MEA, MTO, OPS committees or otherwise).
