1.7 “Other Provincial Policies or Laws…” is missing two relevant pieces of legislation:
(1) The Building Code Act regulates building construction and enables municipalities to pass Property Standards By-laws that can be used to implement Heritage Act objectives. The Building Code may supersede the Heritage Act, for example by permitting the demolition of a property that is designated or listed on the Register without going through the process prescribed by the Heritage Act when the Chief Building Official or Property Standards Officer issues an order. Please refer to this legislation and acknowledge its role in heritage conservation planning practice.
(2) The Municipal Act enables municipalities to provide property tax rebates as incentives for designation. Please refer to this legislation and acknowledge its role in heritage conservation planning practice.
