Section 4.1 and 4.2 of the River and Stream Systems Flooding Hazard Limit Technical Guide, 2002 recognizes that dams, bridges and culverts can result in temporary ponding behind structures.  The Guide recommends that:
The upstream flood line make allowance for the backwater effects caused by the structure.
The downstream flood line represent the natural flood line, making no allowance for the temporary upstream ponding.

It is understood that roads, bridges and culverts are a necessity, but they should not cause an unjustified liability to private property owners and where they do, an allowance should be allowed.

In my attempt to ask LSRCA for such an allowance, it was said that only the Review Board could make such an allowance and the path to request such an allowance of the Board is blocked unless approval is denied. Permits fees, engineered drawing and complete application must first be submitted and denied.

Therefore I could face extreme cost to be denied so that I could ask the Board for such an allowance that would make the initial steps unnecessary
