Schedule 11 – Ontario Heritage Act
Schedule 11 proposes several changes to the Ontario Heritage Act. A noteworthy change is that Council decisions on by-laws to designate or alter a building or structure on a property that is designated under Part IV of the Ontario Heritage Act can now be appealed to LPAT, a decision-making body. Currently, appeals are heard by the Conservation Review Board, which makes recommendations to either Council or the Minister. Another noteworthy change is that there are new mandatory notice and objection provisions for the listing of properties on the Heritage Register. It would appear that Kitchener’s current process is already compliant with the proposed requirements.
