Ministry Zoning Orders are frequently considered (almost exclusively considered) for properties that have been identified to have environmentally sensitive concerns. These properties were purchased by the applicant knowing, or should have known, the identification of the nature of the property. It can therefore be concluded that they intended to use their influence to gain advantages by their position. If a property has been classified as environmentally sensitive through an Official Plan, Zoning ByLaw, or Conservation Authority or Provincial assessment, there should be NO recourse for a MZO or LPAT appeal.
