Waste Designation Recommendation: The Soil Rules should prevail in all cases for removing the “waste” designation.

Waste Designation Recommendation: The wording of the regulation and the soil rules must make it clear that excess soil brought to any reuse site must have an intended reuse, if not, it is considered waste and needs an ECA. Or is sent to a specific waste ECA disposal site.

Registry of Sites and Tracking of Soil recommendation: Excess soil plans and tracking records must be owned and audited by the government.

Source responsibility recommendation: The Excess Soil Management Plan should include a declaration from the owner of the Source site that acknowledges their responsibility for the soil not being waste product.

Environmentally Sensitive Areas recommendation, the definition of this needs to explicity state that areas of high aquifer vulnerability and well-head protection areas, following the designation in provincial and municipal plans. That these areas can not accept any soil above Table 1.
