Regarding Ministry of Environment, Conservation, and Parks (MECP):

The application appears to meet the regulations of MECP however there are several areas that could be challenged, such as 200-250 distance to water. This is a very favourable measurement to the Applicant/Proponent, considering the satellite map seems to show the spreading area has been expanded somewhat. It would seem the spreading area is now greater than 11.7 acres. Another area that is suspect is the soil permeability which is indicated at 5 cm/s and there is no evidence to prove this is accurate considering the dumping/spreading has been continuous for several years. A new study should be requested by MECP at the Applicant/Proponents expense.

There is no indication of other involved parties; i.e. Ministry of Northern Development, Natural Resources and Parks, Ministry of Agriculture, Food and Rural Affairs or the Township of Whitewater Region. We find this a bit odd as the Township of Whitewater has, based on the Official Plan of Renfrew County, issued by-laws that extend the mission of MECP. From discussions with MECP there is support for this extension as the bylaws assist MECP in its mission of stewards of the environment.

Regarding the Township of Whitewater, Renfrew County:

Considering the marshy lands that the creek runs through we feel there is a need to be very conservative with the measurements and restrictions which from the Township of Whitewater Region is 180 metres. This area is very close to a popular recreational area known as Little Lakes. Again considering the current year precipitation we feel there is an increased danger of run-off and E.coli contamination.

Within the Township of Whitewater Region the bylaw states “Seven hundred fifty (750) metres of any subdivision or land zoned for residential development”. There is an indication on the application the closest house off-site is 550 metres. We do not know if this represents the distance to the Country Haven Retirement Home or another house/subdivision as indicated on the satellite map provided by MECP. The Country Haven Retirement Home is well within this distance and makes this application non-compliant.

Further within the Official Plan of Renfrew County there is a provision indicating sites be adequately screened, fenced and posted including all open storage areas and disposal site operations. This site does not have any fencing or posting and is therefore non-compliant.

Based on these non-compliance items and the environment we feel this application should be refused because it would not be possible to move the dumping/spreading area to meet the required distance from the Country Haven Retirement Home even if the fencing and posting were put in place.
