Comment: Based on the documents provided there is a situation with this application. If the Field # 4 is included in this application then there are discrepancies with the application unless the declared amount is included in the Field #3: 41 acres. If it is included then that is appropriate, however it does make the application non-compliant. On the hand drawn document there is an indication of 90 metres to a house from Field #4. Measuring from that house to a sensitive area appears to be about of 200 metres, which certainly makes the total distance to be is less than 450 metres from sensitive areas at 401 Pappin Rd which is school.

If Field # 4 is not included in the Field #3: 41 acres there is a situation where there is an approval in place for a dumping/spreading area which is less than 450 metres from sensitive areas. This is 401 Pappin Rd which is a school. If this is correct then the current permit should be revoked.

e. setbacks to surface waters

· Comment: The stated permeability on the application is 20 – 50 minutes however there is no evidence provided proving this is accurate. We suggest there should be studies to ensure the safety of the environment at the Applicant/Proponents expense such as:

1) Record and evaluation of the site condition;

2) Environmental compliance which would confirm the soil permeability and the drainage factors.

We would think that MECP would require this as we are sure that MECP does not wish to be in a “Walkerton” scenario where there was an independent Commission set up under the Ontario Public Inquiries Act to examine the E.coli (human waste) contamination of the water supply, individuals that signed off were found negligent and punishments were handed out to the individuals that were negligent in their duties.

There is no indication the Applicant/Proponent requested approval from other Ministries such as Minister of Agriculture, Food and Rural Affairs or Ministry of Northern Development, Mines, Natural Resources and Forestry. To our knowledge the Applicant/Proponent did not contact either the Renfrew County or the Township of Whitewater Region. This lack of contact does not relieve the Applicant/Proponent of meeting the requirements of these Ministries and Local Authorities.

In terms of the Renfrew County and the Renfrew County official plan we believe the application is non-compliant. The Renfrew County official plan states:

- Requires that sites be adequately screened, fenced and posted including all open storage areas and disposal site operation.

· Comment: The site is not screened, fenced or posted. The application is therefore not in compliance with the Renfrew County Official Plan.

Considering the Township of Whitewater Region zoning by-laws which are based on the Renfrew County Official Plan there are issues with setbacks. The Township of Whitewater Region zoning by-laws state:

i. Two hundred (200) metres of any dwelling on another lot;

· On the maps provided by the applicant/proponent there is an indication the distance to a dwelling on another lot of 90 metres. As the required setback is 200 metres then this application is non-compliant.

v. One hundred eighty (180) metres of any surface water;

On the maps provided by the applicant/proponent there is an indication the distance to a creek of 90 metres. As the required setback is 180 metres then this application is non-compliant.
