An amendment to Environmental Compliance Approval (air and noise) No. 0501-867L9G with Operational Flexibility was issued to Carmeuse Lime (Canada) Limited, a limestone quarry and lime manufacturing facility located in Ingersoll, Ontario.
The emission sources from the manufacturing and associated processes that exhaust to the air include:
- quarry operations - limestone extraction
- limestone processing including crushing and screening
- limestone calcination in lime kilns
- material handling and storage
This amendment includes the following:
- addition of operation flexibility to the ECA
- approval of changes to previously approved equipment
There is no change in the previously approved lime production capacity of the facility.
Major emissions to the air from this facility include:
- suspended particulate matter
- calcium oxide
- metals such as manganese and nickel
- silica
- products of fuel combustion such as nitrogen oxides, sulfur dioxide and carbon monoxide
The approval is an Environmental Compliance Approval (air) with Operational Flexibility, which is a single approval that replaces all the current Environmental Compliance Approvals for air at this facility and includes the addition of new, or historically unapproved sources for all emissions from the facility.
The Environmental Compliance Approval (air) with Operational Flexibility requires that the company demonstrates compliance on an ongoing basis with:
- Ontario Regulation 419/05
- applicable ministry guidelines for air and noise
- other performance requirements as specified in their conditions
It permits modifications such as process changes, de-bottlenecking or addition of new equipment subject to limits on operational flexibility that include a production limit for the facility specified in the approval. The operational flexibility conditions have a 10 years expiry date. The company is required to make an application for amendment at that time to renew these conditions.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
You’ll need to mail your application that you prepared in step #1 to each of these three parties:

This proposal is for an Environmental Compliance Approval with Limited Operational Flexibility (air), which replaces all the current Environmental Compliance Approvals for air at this facility and includes the addition of new, or historically unapproved, sources for all emissions from Carmeuse Lime (Canada) Ltd., a limestone quarry and lime manufacturing facility located in Ingersoll, Ontario.
The approval includes all sources at the facility, including:
- manufacturing operations from firing kilns
- quarrying limestone
- dust collectors
- material handling
- wind erosion
Emissions to the air from this facility include:
- calcium oxide (also called lime)
- suspended particulate matter (also called dust)
- contaminants from the combustion of fuels (such as sulphur dioxide, nitrogen oxides, carbon monoxide, etc.)
The Environmental Compliance Approval with Limited Operational Flexibility (air), when issued, permits modifications to the facility subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (air).
The limited operational flexibility conditions have an expiry date. The company will be required to make an application for amendment at that time to renew these conditions.
