Approval is granted for a new Environmental Compliance Approval (industrial sewage) for 7475 McLean Road East Inc., as general partner for and on behalf of 7475 McLean Road East LP, for the stormwater management works to serve 7475 McLean Road in the Township of Puslinch, County of Wellington, Ontario.
The proposed stormwater management works include underground storage chambers, storm sewers and two oil-grit separators, discharging to existing ditches located to the east and west of the property.

The Ministry has received one comment which was reviewed and considered during ECA application review.
The comments and our responses are listed below:
Comment:
Wellington Source Water Protection recommends that:
- It is recommended that the Ministry consider this policy and add appropriate terms and conditions to the subject property ECA to address potential impacts to the WHPA-Q and significant groundwater recharge areas. It should be noted that during a site plan application process with the Township of Puslinch, the applicant submitted documentation to sufficiently address the site’s winter maintenance activities, as well as providing a water balance assessment report that addressed pre and post development recharge.
- It is recommended that the Ministry consider reviewing the submitted documents to ensure the best management practices and LID measures proposed are sufficient, if necessary. It is requested that the Ministry consider the above recommendations while reviewing this ECA application and add terms and conditions, as appropriate.
Response:
- The consultant has submitted site-based water balance assessment (WBA) report along with Salt Management Plan and confirmed that "Based on section 3.4 of the WBA, approximately 83 m3 of storage is required to mitigate the infiltration deficit on the site. It is proposed to infiltrate clean water from the rooftops of the proposed buildings to provide the required volumes to maintain the existing water balance on the site. A total of 95 m3 infiltration volume is provided in the infiltration chambers on the site, which exceeds the required volume of 83 m3. The WBA has been attached to this email."
- Considering the recommendations, appropriate terms and conditions has been included in the ECA which include Operation and Maintenance including preparation of operational manual, Temporary Erosion and Sediment Control, and Spill Contingency Plan condition for dealing with potential spills.
- Additionally, effluent discharge limits and monitoring conditions along with annual reporting requirements has been included in the ECA.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
