A new Environmental Compliance Approval (ECA) was issued to Cedar Park Resort Ltd. for approval of upgrades to the existing works for the treatment of sanitary sewage and subsurface disposal of treated effluent from the existing Cedar Park Resort, located at 6296 Cedar Park Road, Bowmanville, Municipality of Clarington, Regional Municipality of Durham.
The existing Cedar Park Resort is a seasonal family campground and water park and consists of:
- 74 existing trailer sites with water and sewer hook-up,
- 39 existing trailer sites without water and sewer hook-up,
- one existing comfort station and the existing water park
The approved upgraded works have a total maximum daily flow of 61,875 litres per day.
The approved works consist of:
The upgraded Works No. one - Main Trailer Park and Comfort Station service the existing comfort station and 74 existing trailer sites with water and sewer hook-up, have a maximum daily flow of 31,450 litres per day and consist of the following:
- one proposed one-compartment septic tank;
- one upgraded two-compartment septic tank; and
- one existing in-ground absorption trench leaching bed
The upgraded Works No. 2 - North Trailer Sites service 15 existing trailer sites without water and sewer hook-up, have a maximum daily flow of 4,125 litres per day and consist of the following:
- one upgraded two-compartment septic tank;
- one upgraded one-compartment effluent pumping chamber; and
- one existing in-ground absorption trench leaching bed
The upgraded Works No. 3 - South Trailer Sites service 24 existing trailer sites without water and sewer hook-up, have a maximum daily flow of 6,600 litres per day and consist of the following:
- one upgraded two-compartment septic tank;
- one upgraded one-compartment effluent pumping chamber; and
- one existing in-ground absorption trench leaching bed
The upgraded Works No. 4 - Water Park, Change Rooms, Snack Bar and Mechanical Room service the Water Park, change rooms, the snack bar and the mechanical room, have a maximum daily flow of 14,600 litres per day and consist of the following:
- one proposed two-compartment septic tank;
- one proposed one-compartment effluent pumping chamber; and
- one proposed in-ground Eljen™ GSF system
The upgraded Works No. 5 - North Park Picnic Grounds, service the existing covered outdoor washroom housing five water closets and two sinks, servicing the open picnic grounds, have a maximum daily flow of 14,600 litres per day, have a maximum daily flow of 2,400 litres per day and consist of the following:
- one upgraded two-compartment septic tank; and
- one upgraded in-ground absorption trench leaching bed
The upgraded Works No. 6 - Owners Residence, service the existing five-bedroom Owners Residence, have a maximum daily flow of 2,700 litres per day and consist of the following:
- two upgraded two-compartment septic tank; and
- two upgraded in-ground absorption trench leaching bed

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

Cedar Park Resort Ltd. is applying for a new Environmental Compliance Approval to consolidate 6 existing on-site subsurface disposal sewage systems into one single approval, with proposed upgrades including:
- a new septic tank to System #1
- a new septic tank, a leaching bed and a pump chamber to System #4
- the expansion of leaching bed for System #5 and System #6.
All subsurface disposal systems are sized to operate with a total design sewage capacity of 61,875 litres per day, and service a seasonal campground located at 6296 Cedar Park Road in Clarington, Ontario.
