On November 15, 2024, a decision was made to approve Amendment No. 2021-11 to the Official Plan of the Sault Ste. Marie North Planning Board, as adopted by the Board through By-law No. 2021-11, without modifications.
This Official Plan Amendment will facilitate the severance of two residential lots, each measuring 0.54 hectares and featuring 184.2 metres of frontage along Lake Superior. The proposed lot sizes are below the 0.8-hectare minimum established for the Shoreline Communities designation in the Official Plan.
The adopted Official Plan Amendment was reviewed for conformity with the Growth Plan for Northern Ontario, 2011, consistency with the Provincial Planning Statement, 2024, and regard for matters of provincial interest as outlined in Section 2 of the Planning Act.
Pursuant to subsection 22(7) of the Planning Act, this decision is subject to appeal, allowing the applicant, public bodies, and the Minister to request a review by the Ontario Land Tribunal no later than 20 days from the date of the notice of decision.

As a result of public consultation on this OPA, the Ministry received no comments through the Environmental Registry of Ontario, and no additional comments through email to Ministry staff.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

- the reasons for your appeal

The Sault Ste Marie North Planning Board adopted a site-specific Official Plan Amendment (OPA) on March 14, 2024, by By-law No. 2021-11. The ministry will review all feedback received before presenting any potential modifications to the Minister of Municipal Affairs and Housing for a decision in accordance with sections 17 and 21 of the Planning Act.
The purpose of this OPA is to allow for the creation of two new lots, through the consent process, that do not meet the Official Plan requirement of being a minimum of 0.8 hectares in size. The proposed OPA exempts the subject property from this policy requirement governing consent applications, thereby enabling the creation of the proposed lots.
The proposed OPA will be reviewed for consistency with the Provincial Policy Statement, the Growth Plan for Northern Ontario, and matters of provincial interest as set out in section 2 of the Planning Act. Matters of provincial interest include the protection of ecological systems, conservation and management of natural resources, efficient land use, conservation of energy and water, waste management, among other interests.
