An approval was granted to Pure Flavor Farms GP Inc., as general partner and on behalf of Pure Flavor Farms LP, for an amendment to the Environmental Compliance Approval (ECA) number 2763-CD33SX for the modifications to existing stormwater management works serving the existing Phase 1, 2, and 3 greenhouse facilities to accommodate new Phase 4 greenhouse development for the collection, transmission, treatment and disposal of stormwater run-off from Phases 1 ~ 4 greenhouses development located at 966 Highway 77, in the Municipality of Leamington, County of Essex, Ontario.
After the proposed modifications, the approved stormwater management works include the following:
WATERSHED 1
One stormwater management system serving Phases 1 to 4 greenhouses, warehouses, connector houses, bunkhouses and accessary driveway and parking areas with a total catchment area 55.11 ha, consists of roof water drainage pipe systems, swales and on-site storm sewers, discharging roof-top runoff and other surface runoff into a stormwater management pond - Watershed 1 Pond that has a permanent storage volume of approximately 74,032 cubic metres and a total active storage volume of 48,160 cubic metres for the 100 year storm event, complete with an emergency overflow spillway, one outlet pumping station and one outlet structure discharging into a municipal drain - Lundy Drain along 966 Highway 77 (Mersea Road 10).
WATERSHED 2
One stormwater management system serving north-east parking lot with a total catchment area of 1.27 hectares, consists of surface water ponding with a maximum storage volume of 395.3 cubic metres for the 100 year storm event, complete with a outlet structure and one oil/grit separator, discharging into the Lundy Drain.
WATERSHED 3
One stormwater management system serving Phase 4 bunkhouses and Phase 1 parking areas and bunkhouses, with a total catchment area 4.37 hectares, consists of roof water drainage pipe systems, swales and on-site storm sewers, discharging roof-top runoff and other surface runoff into a stormwater management pond - Watershed 3 Pond that has a permanent pool with a water depth of 0.6 metres and a total active storage volume of 2,421 cubic metres for the 100 year storm event, complete with an emergency overflow spillway, one outlet pumping station, one outlet structure (CBMH1), and one oil/grit separator, discharging into the Lundy Drain.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application
