Approval is granted to amend the existing Environmental Compliance Approval No. 3168-BH9JQY issued to EcoVac Solutions Ltd. for a 0.157 hectare site to be used as a liquid soil processing facility located at 60A Baywood Road, Toronto, Ontario.

The site will receive liquid soil slurry from hydro-vac vehicles from sites within Ontario.

The amended approval includes:

  1. A maximum daily receiving capacity of 750 cubic meters of liquid soil per day.
  2. Temporary storage and management of stone, sand and clay in designated outdoor storage area bunkers.
  3. Sampling and testing of process water prior to reuse offsite.

The hours of operation at the facility includes 24 hours per day, seven days per week-365 days per year.

The facility will serve the Province of Ontario.

The ministry received the following comments from neighbor notification required for waste disposal sites.

Why wont outdoor materials be covered?

Response: MECP does require the facility to install cloth barriers on the fence to mitigate fugitive dust emissions on neighboring properties.

Will this increase truck traffic?

The amendment to the facility reduces the quantity of liquid soil the facility has proposed to accept. This will not result in an increase to truck traffic.

How do we know liquid soil is not toxic or harmful to human health?

The facility receives liquid soil that is processed indoors. MECP has imposed conditions for the processed liquid soil to be tested before reuse.

Start the process to appeal

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

This proposal is to amend Environmental Compliance Approval (Waste Disposal Site) Number 3168-BH9JQY for EcoVac Solutions Ltd.’s liquid soils processing and transfer facility used for the recovery of soil and water from low-risk hydro-excavation activities for beneficial reuse.

The facility is seeking to amend its outdoor storage of recovered soils (stone, sand and clay) to allow for the maximum uncovered storage of 700 cubic metres of reclaimed soils (stone, sand, and clay) in accordance with the “Rules for Soil Management and Excess Soil Quality Standards,” made under O. Reg. 206/19 On-Site and Excess Soil Management. Further, the proposed amendment is seeking to include the collection of on-site stormwater from the yard and uncovered stockpiles and transfer it to the facility’s liquid soils processing system for treatment prior to reuse. Lastly, the proposed amendment is to allow for the treatment and on-site transfer of recovered water to third-parties for use in their hydro-excavation equipment. No change is proposed to the liquid soils’ recovery process or processing equipment.

There are no proposed changes to the site’s receiving and shipping. Receiving and shipping may take place between 5:30 am to 9:00 pm, Monday to Saturday. On site processing (no receipt or shipping of materials) at facility may occur 24 hours a day, 365 days of the year.

The site services the Province of Ontario.
