A new Environmental Compliance Approval (Air and Noise) has been granted to Norshred Inc. for the operation of a mobile waste processing operation to de-pollute and shred End of Life Vehicles (ELV's) at licensed facilities, including one (1) shredder, one (1) excavator, one (1) loader, two (2) containers, and associated diesel engines.

The equipment will be used to process vehicles throughout the Province of Ontario and can operate between the hours of 7:00 a.m. and 7:00 p.m. Contaminant emissions to the atmosphere include total suspended particulates, quartz and oxides of nitrogen.

The comment was reviewed and where appropriate considered in the Ministry’s decision.

Issue 1 – NOISE

Comment Summary

The commenter was concerned about noise pollution.

Reviewer’s Response:

The Ministry conducted analysis of information provided in the submitted Acoustic Assessment Report, related to noise emissions from the proposed mobile plant operations (shredding and de-pollution).

The Environmental Compliance Approval (Air and Noise) will address:

  • the scenarios with and without mitigation (barrier) for the shredding and de-pollution operations;
  • related separation distances/setbacks for these operations, and
  • specify time restrictions for the mobile plant operations (hours per day, days per year).

Issue 2 – FIRE

Comment Summary

The commenter was concerned about the potential for fires and explosions.

Reviewer’s Response:

Enforcement of the Ontario Fire Code is the responsibility of the municipality in which the equipment is operating, not the Ministry.

Issue 3 - DUST

Comment Summary

The commenter was concerned about dust being carried beyond the boundary of the property where the equipment is operating.

Reviewer’s Response:

A condition in the Environmental Compliance Approval (Air and Noise) requires the Company to develop a Best Management Practices Plan for fugitive dust that will be approved by the District Office where the Company is located.

In addition, the Environmental Compliance Approval (Air and Noise) includes minimum separation distances to ensure compliance with the suspended particulate material limit.

Issue 4 – MINISTRY NOTIFICATION

Comment Summary

The commenter wanted the Ministry to be notified well in advance of the equipment operating at any site.

Reviewer’s Response:

A standard condition in the Environmental Compliance Approval (Air and Noise) requires the Company to notify the Ministry at least ten (10) business days in advance of locating the equipment at each operating site.

Issue 5 – WASTE

Comment Summary

The commenter was concerned the management of waste generated.

Reviewer’s Response:

A mobile waste processing Environmental Compliance Approval (Waste) is issued as a waste management approval and is not a prescribed instrument under the Environmental Bill of Rights.  The Company must ensure that the processing of end-of-life vehicles conducted at any Site will be in accordance with the requirements of Regulation 347 and Ontario Regulation 85/16 and the conditions in the Environmental Compliance Approval (Waste).

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see
  2. A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
  3. Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal

3. Mail your application

Description of instrument

This proposal is for a new Environmental Compliance Approval (Air) for Norshred Inc. for the operation of a mobile waste processing operation to de-pollute and shred End of Life Vehicles (ELV's) at licensed facilities.

Approval is for;

  • one (1) shredder,
  • one (1) conveyor waste bin,
  • one (1) loader, and
  • associated diesel engines.

The equipment will be used to process vehicles throughout the Province of Ontario and can operate between the hours of 7 am and 7 pm. Contaminant emissions to the atmosphere include chromium, nickel, cobalt, iron, aluminum, manganese, total suspended particulates, and oxides of nitrogen.
