Approval for the establishment of industrial stormwater management Works for the Trucking and Warehousing Company located in the City of Guelph for the collection, transmission, treatment and disposal of stormwater run-off from a total catchment area of 1.21 hectares site, to provide Enhanced Level of water quality protection and erosion control, and to attenuate post-development peak flows to pre-development peak flows for all storm events up to and including the 100-year storm event, discharging to the Dawson Road side ditches and finally to the Grand River, approximately 25 kilometres downstream, consisting of the following:
Proposed Works:
Quantity Control: Parking Lot Surface Storage 22 parking lots having a total surface area of 3700 square metres with a ponding depth of 0.207 metres, to provide 337 cubic metres of storage; to discharge into a 600 millimetres diametres site storm sewer catchbasin manhole STM CB-7 coupled with 162 millimetres diametres pipe orifice restrictor outlet into an oil and grit separator described later on;
Baseflow Augmentation: Infiltration tank (Stormtech Model SC-740) or approved equivalent) sized for detention of the roof drainage into 27 chamber subsurface proprietary designed infiltration tanks, located under the landscaped area, having a total length of 32.66 metres, a width of 3.4 metres, a base width of 1.3 metres per chamber a maximum allowable storage depth of 0.76 metres and a maximum available storage volume of 180 cubic metres, comprised of a 150 millimetres deep clear stone layer overlying a 150 millimetres deep sand filter layer, installed over non-woven filter fabric around; and an emergency overflow outlet discharging to 300 millimetres diametres site storm sewers;
Quality Control: provision of an Oil/grit separator( Hydroguard Model HS-10).

If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

This proposal is for a new Environmental Compliance Approval (sewage) to be issued to Red Leaf Logistics Inc. for the establishment of stormwater management works in support of trucking operations, for the collection, transmission, treatment, and disposal of stormwater run-off from a site located at 170 Dawson Road, near the corner of Campbell Road and Dawson Road in an industrial area in the north central portion of Guelph, Ontario.
The stormwater management works is designed for quantity and quality control provided through storm sewers, ditches, an infiltration Gallery, and an Oil Grit Separator; with an ultimate discharge towards the Grand River.
