Application 52-C-247305 was approved on January 21, 2025, with conditions. This approval permits the transfer of an easement approximately 21m in length and 50m2 in area in favour of Bell Canada to facilitate the installation and maintenance of telecommunication cables on a property identified as Lot 10, Concession 1 (PIN 730990042) in the Township of Cochrane, District of Sudbury.

The subject lands are approximately 0.3257 hectares in size and contain a residential dwelling, a shed and a septic system. According to PLAN 53R-21320,there is an existing Hydro One Easement (SD393723) of approximately 22 meters in length located along the southern boundary of the subject property. 

The subject lands are approximately 4 kilometres northeast of the Township of Chapleau. Surrounding land uses primarily consist of residential units to the east and west, with the shoreline of Chapleau Lake to the north and Old Fort Road to the south. Both the subject lands and the adjacent residential properties have access to Old Fort Road.

This application does not propose any new development or construction and will instead enable Bell Canada to access their underground utility in the case that maintenance or replacement is required.

The application was reviewed for consistency with the environmental policies of the Provincial Planning Statement (e.g. natural heritage, water quality protection). No public comments were received, or concerns identified. The decision to approve the consent is consistent with the Provincial Planning Statement and will not have a significant impact on the environment.

The approval can be appealed by a specified person or public body, as defined in s. 1(1) of the Planning Act, using the procedure outlined below. Notice to appeal the decision to the Ontario Land Tribunal must be filed with the Minister of Municipal Affairs and Housing on or before February 10, 2025.

The applicant has two (2) years to satisfy conditions, otherwise the approval will lapse.

Application 52-C-247305 proposes the creation of an easement in favour of  Bell Canada to accommodate the installation of telecommunication cables.

The subject lands are approximately 0.03257 hectares in size and contain a residential dwelling, a shed, and a septic system. Surrounding land uses primarily consist of residential units to the east and west, with the shoreline of Chapleau Lake to the north and Old Fort Road to the south.

There is an existing Hydro One easement (SD393723) located along the southern boundary of the subject property. The length of this easement is 22.38 metres and was created to allow for hydro cables and was registered on title on March 16, 2020. The length of the proposed easement for Bell Canada would be 20.78 metres.

The subject lands are approximately 4 kilometres northeast of the Township of Chapleau. Both the subject lands and the adjacent residential properties have access to Old Fort Road. Old Fort Road is a private road and maintained by all of the landowners with properties abutting it.

No new development has been proposed as a result of this application.

The application will be reviewed for consistency with the environmental policies of the Provincial Policy Statement (e.g. natural heritage, water quality protection). Public comments received or concerns identified will be considered in the review to determine whether the application is consistent with the Provincial Policy Statement and whether it would have any significant impact on the environment.  If you have any questions, or would like to submit comments, please do so either online (below), by letter or phone to the contact person listed. Please submit your comment during the 30-day public consultation period and reference the Environmental Registry Number 019-9270.  Your personal information may be used in the decision-making process on this proposal and it may be used to contact you if clarification of your comment is required. Questions about this collection should be directed to the contact listed.  If a person or public body that wishes to file an appeal in respect of the proposed consent does not submit written comments to the Minister before the Minister gives or refuses to give a provisional consent (e.g., during the public consultation period), the Ontario Land Tribunal may dismiss the appeal. Appeal of a decision of the Minister in respect of this consent may be made by a specified person or any public body not later than 20 days after notice of the decision is given. If you wish to be notified of the decision of the Minister in respect of the proposed consent, you must make a written request to the Minister at the contact address.  As required under the Planning Act, a public notice was published in the Chapleau Express on December 19, 2024.
