An amendment approval is granted to Norris Construction Management Inc. ( NCM Inc. ) to allow for the processing of hydrovac slurry waste and dry soils including non-hazardous contaminated soils as a Class 1 Soil Management – Processing site. In addition, Condition 3.9, that required a groundwater and surface water assessment if a unlined storage pond is used to store process waters from the hydrovac slurry soils separation, is removed. The amended approval allows for the installation and operation of a closed loop process water treatment plant that will have no discharge to the ground or surface waters.
- The daily maximum waste volumes for hydrovac slurry will be 450 cubic metres per day maximum instead of 900 cubic meter in Phase 3.
- Maximum storage volume of the processed dry soil at any time is 3,150 cubic meter.
- The daily maximum volume of dry non-hazardous soils will be 800 tonnes and a maximum storage volume of unprocessed soils at any time of 2,500 tonnes.
- The incoming excess dry soils meeting the Table 1 and 2 for commercial and industrial, and residential, parkland and institutional land uses of O. Reg. 153/04, as amended, can be accepted at the Site.
- The approval requires testing of soil quality of the processed dry soil for reuse or disposal depending on tested soil quality. Testing and end use destinations ( reuse for construction , beneficial reuse sites , landfill ) would follow the requirements of O. Reg 406/19 and Excess Soil Standards.
- The approved operating hours are Monday – Saturday 7 am to 7 pm .

The City of Ottawa provided input (letter sent via email on November 29th, 2024). In its response letter, the City indicated concerns with respect to wastewater generated via closed loop system and its disposal, and operation of an unlined pond. The City indicated that Condition 3.9 removal should be made contingent upon decommissioning and remediation of the existing storage pond.
Response: The proponent intends to decommission the on-site pond as per the DOR. Condition 2.55 is included to address the City’s concern.

Start the process to appeal
If you’re an Ontario resident, you can start the process to appeal this instrument decision.
First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal

3. Mail your application

Norris Construction Management Inc. (NCM Inc.) is applying to amend the Environmental Compliance Approval No. 6469-ADXJVG issued for a waste disposal site for the processing of hydrovac slurry waste and dry soils including non-hazardous contaminated soils as a Class 1 Soil Management – Processing site. The amendment requested is to remove Condition 3.9 of the approval that required a groundwater and surface water assessment if a unlined storage pond is used to store process waters from the hydrovac slurry soils separation, and to allow for the installation and operation of a closed loop process water treatment plant that will have no discharge to the ground or surface waters.
The daily maximum waste volumes for hydrovac slurry would be in three phases:
- phase 1 allowing 300 cubic metres,
- phase 2 allowing 600 cubic metres, and
- phase 3 allowing for 900 cubic metres per day maximum
Maximum storage volumes for hydrovac slurry soils will be 1,230 cubic metres for phase 1, 2,460 cubic metres for phase 2, and 3,690 cubic metres for phase 3. Water removed from hydrovac slurry will be reused within the treatment process.
The daily maximum volume of dry non-hazardous soils would be 800 tonnes and a maximum storage volume of unprocessed soils of 2,500 tonnes. Dry soils would be blended with hydrovac slurry to separate soils to produce reusable stone, aggregates, sands and a fine soils filter cake. Soil materials (sands, fine soils) would be tested to determine soil quality for reuse or disposal depending on tested soil quality. Testing and end use destinations (reuse for construction, beneficial reuse sites, landfill) would follow the requirements of O. Reg. 406/19 and Excess Soil Standards.
This application requests to extend the hours of operation from Monday – Saturday, 7 am to 7 pm . Currently the hours allow for operation from 8 am to 5 pm. This application also requests that the facility be allowed to receive waste delivered by hydrovac trucks on an emergency basis after hours.
The waste management facility is located on a 1.75 hectares site at 200 Maple Creek Court, Ottawa, Ontario. Waste received would be generated by residential, municipal, industrial, commercial and institutional sources within a service area of Eastern Ontario.
