Comments relevant to the water taking proposal were considered as part of the review of the application. The main concerns raised were regarding the following:

  • the potential for groundwater takings to impact nearby well users
  • the need for contingency measures during periods of low water availability
  • whether the permitted volume continues to reflect actual usage under the existing permit

In consideration of these comments, the technical information associated with this taking was reviewed, and it was determined that there is no evidence of well interference. As such, the risk of interference with nearby private wells is considered low. New monitoring and reporting conditions have been included in the permit to strengthen oversight of the taking. These conditions require daily recording of surface water levels and continuous groundwater level monitoring, which will provide additional data to support future evaluations of the taking and help identify any potential impacts over time.

With respect to low water response conditions, the Ontario Low Water Response (OLWR) Program is intended to apply to regulated and non-regulated surface water users and employs a collaborative approach to manage surface waters during drought to avoid unnecessary environmental and economic impacts. The OLWR Program was not developed to apply to groundwater takings, as groundwater resources generally respond to drought on a longer timescale as compared to surface water resources. The well in use draws from a bedrock aquifer that is not hydraulically connected to shallow surface water features, and as such, the OLWR Program would not apply.

The reported water use data were also reviewed in consideration of the suggestion to revise the permitted volume. It was concluded that the currently authorized volume remains appropriate based on the nature of the operation and the variability in water demand. A condition has been included in the permit requiring the implementation of best management practices for irrigation to support efficient water use and reduce pressure on shared resources. The Ministry supports the continued application of water conservation practices and encourages their ongoing use.

Based on the technical review, historical use, and operational needs of the site, the permitted volume remains appropriate. Conditions of the permit are considered sufficient to ensure that any future impacts are identified and addressed through adaptive management.

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
    • the grounds (facts) you’ll be using to appeal
    • the outcome you’d like to see

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal
