The establishment of industrial process water treatment works to service Coloured Aggregates Inc’s Aggregate Wash Facility using a closed loop settling pond, located at 163 Marmora Mind Road, in the Town of Marmora and Lake, for the collection and treatment of effluent water from the wash plant to allow this effluent to be continuously recycled for the propose of washing aggregate. The closed loop settling pond will also collect direct rainfall runoff and runoff from an upstream site area all totalling 0.225 hectares. (within a gross site area of 10.8 hectares of the old mine site), which is designated to supplement the process water and assist with loses in the system from leaks, spills and evaporation.
Any surplus water entering the system will drain via overflow culverts to the south side of the pond and from there follow existing grade to the east and north draining via sheet flow consistent with the balance of the undeveloped site.
Proposed works include:
- A Forebay consisting of twin 20 metres long, by four metres wide cast in place concrete forebays with vertical side and end walls providing a maximum settling depth of 1.5 metres. Each forebay will be fed with wash plant effluent from site drainage piping with inlets set at 90 degrees to the direction of flow through the forebays to a downstream linear pond. Each forebay will be provided with a concrete ramp to facilitate cleaning of collected sediment from the wash plant effluent.
- A wet lined Pond, V- shaped, with length of 35.5 metres, maximum top width of seven metres and a maximum depth of 1.3 metres , to have a normal operating depth of one metre, permanent storage volume of 115 cubic metres. and a maximum storage volume of 161 cubic metres. The permanent depth in the pond shall be controlled by twin reverse graded 300 millimetres diameter culverts with an invert at 167 msl which is 1 metres above the pond invert elevation. During wash plant operation, the pond will be drained by a 450 millimetres diameter Hickenbottom drain with 25 millimetres perforations protected with rip rap. The Hicketbottom drain is connected to a manhole that houses the intake for the circulation pump that then feeds water from the pond to the wash plant.
- Overflow pipes: twin 300 millimetres pipes to discharge pond water incase of non working stormy situation; designed adequately for 100-year event flow on the pond canopy roof and developed site area totalling 0.225 hectare.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:

- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal
