On October 23, 2019 we approved the amendment of Environmental Compliance Approval No. 2369-AAYNTD with Limited Operational Flexibility (Air) which replaces all the current Environmental Compliance Approvals for Air at this facility and includes the addition of new, or historically unapproved, sources for all emissions from Colacem Canada Inc., a cement plant located in the Township of Champlain, United Counties of Prescott and Russell.

The new ECA No. is 1536-B5EKKN.

The application includes all sources at the facility, including:

  • raw material storage/silos
  • raw material preparation
  • clinker production
  • cement grinding and distribution

Emissions to the atmosphere from this facility include calcium oxide, ammonia, ferric oxide and nitrogen oxides.

The Environmental Compliance Approval with Limited Operational Flexibility (Air) requires that the company demonstrate compliance on an ongoing basis with Ontario Regulation 419/05, applicable Ministry Guidelines for Air and Noise and other performance requirements as specified in their conditions.

It permits modifications such as process changes, de-bottlenecking or addition of new equipment subject to limits on operational flexibility that include a production limit for the facility to be specified on the Environmental Compliance Approval with Limited Operational Flexibility (Air). The limited operational flexibility conditions have an expiry date. T

he company will be required to make application for amendment at that time to renew these conditions. Of specific public interest, one condition that will be included on the Environmental Compliance Approval with Limited Operational Flexibility (Air) will require the company to make available, at all times, at the facility for inspection by interested members of the Public, a table (Emission Summary Table) that documents the facility's compliance with Ontario Regulation 419/05.

This application was submitted in conjunction with MECP Reference Number 2369-AAYNTD, for the approval of Industrial Sewage Works. The ECA. This approval is issued in conjunction with ECA (Sewage Works) #9996-B6YQK9.

Comments received were reviewed and, where appropriate, were considered in the our decision whether or not to proceed with this proposal. In this case, comments were consistent with concerns within the ministry and, as a result, terms and conditions were added in the Environmental Compliance Approval. These conditions do not represent all conditions imposed on the instrument holder, but rather those that are directly in line with comments received.

One hundred and seven (107) comments were received during the commenting period. Six (6) written comments were also directed to the ministry after the commenting period ended.

The applicant has demonstrated that when operated in accordance with this Environmental Compliance Approval, the air and noise emissions from the approved equipment would be in compliance with this Ministry’s applicable acts, regulations and guidelines, specifically, s.9 of the Environmental Protection Act (EPA), O.Reg. 419/05: Air Pollution: Local Air Quality, including Ministry air quality standards and noise guidelines.

The commenters have raised the following concerns on the proposal:

Concern

Concerns about greenhouse gases, carcinogen chemicals, mercury, heavy metals, and dioxin and furans from the kiln stack.

Response

The company has demonstrated that the Facility meets the Ministry's applicable air requirements and standards. The standards set under the O.Reg. 419/05 are found on scientifically defensible rationales based on human health or environmental effects or nuisance effects. To ensure compliance with Ministry’s requirements, the Approval includes the following terms and conditions:

  • A source testing program to confirm the estimated emissions from the kiln, to ensure compliance with O.Reg. 419/05
  • Continuous monitoring of NOx and SO2 concentration at the kiln stack
  • Collection of material analysis of fuel and raw materials to ensure optimal production condition
  • Develop start-up, shut down and upset procedures to ensure optimal production condition
  • Develop and implement detailed complaint response procedure for recording, investigating and adequately addressing complaints

Concern

Concerns about fugitive dust with diameter less than 10 microns.

Response

The company completed an additional assessment of fugitive dust with diameter less than 10 microns such as PM10 and PM2.5 and the results were below the Ontario’s Ambient Air Quality Criteria (AAQC) screening levels. AAQCs are desirable concentrations of contaminants in air and are used to assess general air quality resulting from all sources of contaminants in air. The approval requires the company to update and implement a fugitive dust management plan to control fugitive dust emissions. Also, the company is required to monitor the performance and establish operational requirements for all dust control equipment onsite.

Concern

This cement plant would be the third heavy industry within a 5 kilometers radius, IVACO Steel Mill and the L’Orignal Quarry, owned by Colacem. The cumulative effects of the cement plant and those of the other industries in the vicinity should be considered.

Response

The company has conducted cumulative effect study including the neighboring quarry and the steel mill. The predicted cumulative concentrations of common contaminants of concern show results that are below the AAQC levels.

Concern

Concern regarding the volume of the discharge and potential off-site flooding. Risk of off-site impacts on the receiving drain and Ottawa river

Response

Concerns regarding impacts from their industrial sewage works were reviewed and, where appropriate, considered in Sewage Work ECA Application Reference No. 2369-AAYNTD.

Concern

Concerns about noise from 80 to 100 heavy trucks per hour, blasting, smelter, outside machinery and junk movement.

Response

The company has demonstrated that the facility is compliant with the ministry’s applicable noise requirements. The on-site truck activities and all other noise sources have been included in the assessment. There are no blasting or smelter activities on site. Cumulative noise assessment has also been conducted with the adjacent quarry. The approval requires the company to comply with the Ministry Publication NPC-300 at all times

Concern

Concerns about re-zoning, agriculture degradation, tourism and overall social and economic development.

Response

The comments received were reviewed and found to have no direct impact on the ministry’s decision.

Appeal process for decisions published before June 1, 2021

If you’re an Ontario resident, you can start the process to appeal this instrument decision.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.

If the appellate body grants leave, the appeal itself will follow.

Seek leave to appeal

To seek leave to appeal, you need to do these three things:

  1. prepare your application
  2. provide notice to the minister
  3. mail your application to three parties

1. Prepare your application

You’ll need to prepare an application. You may wish to include the following things in your application:

  1. A document that includes:
    • your name, phone number, fax number (if any), and/or email address
    • the ERO number and ministry reference number (located on this page)
    • a statement about whether you are a resident in Ontario
    • your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
    • the parts of the instrument that you’re challenging
    • whether the decision could result in significant harm to the environment
    • the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision

What is considered

The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:

  1. is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
  2. could the decision you wish to appeal result in significant harm to the environment?

2. Provide your notice

You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.

In your notice, please include a brief description of the:

  • decision that you wish to appeal
  • grounds for granting leave to appeal
