The application for consent, 60-C-216880 is draft approved subject to conditions. The applicant has two years to satisfy standard conditions of draft approval, otherwise approval will lapse. Conditions include a requirement for an undertaking from the person registering the documents agreeing to register the consolidations of the severed with the abutting property (PIN 42150-0411) once the land transfers have been registered. The last date to appeal the decision in May 23, 2023.
Effets de la consultation
Letters of objection were received from Wauzhushk Onigum Nation and Niisaachewan Anishinaabe Nation as a result of the ERO posting 019-5608. Further discussions took place to determine potential adverse impacts to Aboriginal and Treaty rights. As this application is technical in nature, does not create any new development rights, and is consistent with the Provincial Policy Statement, the Ministry approved the application.

You can appeal all or part of this this instrument to the appeal to the Local Planning Appeal Tribunal (LPAT) by submitting a notice of appeal to the Minister of Municipal Affairs and Housing.
There is an additional “leave to appeal” right under the Environmental Bill of Rights.
Who can appeal
A notice of appeal can be submitted by:
- individuals
- corporations
- public bodies
A notice of appeal can’t be submitted by:
- an unincorporated association
- an unincorporated group
You can, however, submit a notice of appeal as a member of the unincorporated association or group.
You have to have made an oral submission at a public meeting or a written submission to the council before the official plan amendment was adopted. Note: this is not required if you are appealing a proposal for provisional consent (no official plan in place).

The purpose of this application 60-C-216880 is to sever 0.36 hectares from PIN 42151-0408 to be added to PIN 42151-0411 as a lot addition. The lands to be severed and transferred as a lot addition are 0.36 hectares with 65 metres of frontage and 60 metres of depth. The lands receiving the addition are currently 1.17 hectares with 65 metres of frontage and varying depth between 107 and 52 metres. The retained lands will be 18 hectares with 1061 metres of frontage and 400 metres of depth. The lands to be transferred contain a residence built in 1973 which is owned by the owners of PIN 42151-0411. The residence has always been thought to be a part of the property described as PIN 42151-0411, and the purpose of this application is to recognize the land ownership as its been traditionally been used. The lands to be transferred and the lands receiving the addition are currently and proposed to be used for residential use. The retained lands contain a seasonal residence built in 1950 and no new development is proposed. The retained lands are currently and proposed to be used for resource-based recreational use.
