This Environmental Compliance Approval establishes an industrial stormwater management works to serve Procor Limited's Rail Car Facility Expansion Site for the collection, transmission, treatment and disposal of stormwater run-off from a total catchment area of 14.6 hectares to provide water quality protection and erosion control, and to attenuate post-development peak flows to pre-development peak flows for all storm events up to, and including, the 100-year storm event, discharging to the new driveway culvert at Procor Drive and ultimately to the Porter Creek Drain, consisting of the following:

South Catchment Area:
Interception and conveyance:
The storm water run in this existing catchment area on the south side of the property is drained through 200 millimetre diameter Big ‘O’ pipe wrapped in filter fabric materials through a series of catchbasins that run parallel and between the railway tracks which provide ponding areas that drain into a swale that outlets to the west ditch along Procor Drive. The discharge from both the East and South Catchment Areas run north to a new oil/water separator 1 prior to finally discharging north into the ditch along Procor Drive.

East Catchment Area:
Interception and conveyance:
The stormwater run-off in this existing catchment area on the east side of the property is drained through 100 millimetre diameter Big ‘O’ pipe wrapped in filter fabric materials into a new oil/water separator 1 prior to discharges into existing outlets into the west ditch along Procor Drive.
Oil/water separator:
Located at northeast corner of property, to provide spill control for East and South Catchment areas, having a maximum oil storage capacity of 473 litres, a total sediment capacity of 0.3 cubic metres and a maximum treatment flow rate of 424 litres per second, and discharges north to the ditch along Procor Drive via 375 millimetre outlet storm pipe allowing a maximum discharge of 355 litres per second under 100-year storm event.

North Catchment Area (10.15 ha):
Interception and conveyance:
Surface and ground water from the rest of the property which is currently used as farm lands but to be developed will be collected in a network of Big ‘O’ pipes and catch basins to discharge into a wet pond (stormwater reservoir) as described below:
Wet pond:
Located at the north side of the development running east to west for quality and quantity control: with a permanent storage volume of 110 cubic metres at a pool depth of minimum 710 millimetres, an extended detention volume of 1,300 cubic metres, and a total storage volume of 1,410 cubic metres at a total pond depth of 1,000 millimetres, including two 250 millimetre diameter inlet pipes and one 300 diameter inlet pipe. The outlet structure is comprised of a 450 millimetre diameter storm outlet pipe allowing a maximum discharge of 468 litres per second under the 100-year storm event into existing ditch located along the east side of the property at Procor drive; including erosion/sedimentation control measures and all other appurtenances essential for the proper operation of the aforementioned works.

First, you’ll need to seek leave (i.e. get permission) from the relevant appellate body to appeal the decision.
If the appellate body grants leave, the appeal itself will follow.
Seek leave to appeal
To seek leave to appeal, you need to do these three things:
- prepare your application
- provide notice to the minister
- mail your application to three parties
1. Prepare your application
You’ll need to prepare an application. You may wish to include the following things in your application:
- A document that includes:
- your name, phone number, fax number (if any), and/or email address
- the ERO number and ministry reference number (located on this page)
- a statement about whether you are a resident in Ontario
- your interest in the decision, and any facts you want taken into account in deciding whether you have an interest in the decision
- the parts of the instrument that you’re challenging
- whether the decision could result in significant harm to the environment
- the reason(s) why you believe that no reasonable person – having regard to the relevant law and to any government policies developed to guide decisions of that kind – could have made the decision
- the grounds (facts) you’ll be using to appeal
- the outcome you’d like to see
- A copy of the instrument (approval, permit, order) that you you are seeking leave to appeal. You’ll find this in the decision notice on the Environmental Registry
- Copies of all supporting documents, facts and evidence that you’ll be using to appeal
What is considered
The appeal body will consider the following two questions in deciding whether to grant you leave to appeal:
- is there is good reason to believe that no reasonable person, with respect to the relevant law and to any government policies developed to guide decisions of that kind, could have made the decision?
- could the decision you wish to appeal result in significant harm to the environment?
2. Provide your notice
You’ll need to provide notice to the Minister of the Environment, Conservation and Parks that you’re seeking leave to appeal.
In your notice, please include a brief description of the:
- decision that you wish to appeal
- grounds for granting leave to appeal
